Court Junks Deniece Cornejo's Petition For TPO Against Vhong NavarroThe Taguig City Regional Trial Court junked the petition for a temporary protection order (TPO) filed by model Deniece Cornejo against "It's Showtime" TV host Vhong Navarro.
The court rejected the petition because of "lack of merit."
The TPO petition was filed last February 4 (Tuesday), seeking to order the comedian-TV host from approaching or communicating with Deniece. The TPO would also prevent Vhong, his lawyers and the media from talking about the alleged rape case filed by the model against the TV host.
A 30-minute hearing was conducted on the TPO petition. It was attended by Deniece, her lawyer Atty. Howard Calleja and Vhong's lawyer Atty. Alma Mallonga. The latter told the press that it is not within the court's powers to grant a gag order against all TV stations, social media and any third person.
But the basis for the junking of the TPO petition was because of a lack of basis under RA 9262 or the Violence Against Women and Children Act. The law covers women and their husbands, ex-husbands, common-law partners or anyone they are dating or have sexual relations with. Since Deniece and Vhong have no relationship, the law cannot be imposed on them.
Their relationship, based on Deniece's allegations, is the purported rape that happened last January 22. But the court said such a relation does not fall under RA 9262.
Meanwhile, the Department of Justice (DOJ) has already submitted for resolution the rape case Deniece filed against Vhong. The preliminary investigation was scheduled on the same day the TPO petition was denied. It is being heard by an all-female panel.
The next hearing will be on February 21. The department requires Deniece to appear personally along with Cedric Lee, Bernice Lee and the other personalities involved in the alleged mauling of the TV host.
