Lawyer Jesus Falcis weighed in on the matter, highlighting the legal implications of posting private messages without consent. He explained that even those accused of wrongdoing are protected by privacy laws. Sharing private conversations publicly could lead to cyberlibel charges or violations of the Data Privacy Act.

The National Privacy Commission has clarified that sharing screenshots revealing the identities of individuals may breach the Data Privacy Act. However, redacting identifying details could exempt the act’s application. Despite this, Falcis warned that victims of infidelity might face harsher penalties under privacy laws than under cyberlibel provisions.

Falcis suggested that victims of infidelity, particularly women, explore alternative legal remedies. The Violence Against Women (VAW) Act allows individuals to file cases for psychological violence caused by betrayal. In such cases, courts may accept screenshots as evidence without violating privacy laws. The Supreme Court has ruled that presenting screenshots in court does not breach privacy rights.

Public Reaction and Gender Disparities

The controversy has drawn attention to gender biases in public reactions. Falcis pointed out that misogynistic narratives often place undue blame on women, overshadowing male accountability. He criticized the disproportionate scrutiny faced by Maris Racal compared to Anthony Jennings.

Such actions could expose individuals to legal risks that outweigh any perceived emotional benefits.
